STEPHEN E. ZAINO

 

STEPHEN E. ZAINO is a member of both the New York State and Florida State Bars and is admitted to practice in the United States District Court for the Eastern and Southern District of New York, U.S. Supreme Court and U.S. Court of Appeals for the Federal Circuit, U.S. Court of Military Appeals, and U.S. Claims Court. He is a graduate of the State University of New York at Stony Brook (B.A. with honors, Foundation Award) and of the New York Law School receiving his law degree in 1984.


Mr. Zaino concentrates in commercial and banking litigation representing major banking institutions. He litigates both plaintiffs and defendants matters including contracts, real estate, construction, corporate and partnership law, commercial leases, landlord/tenant proceedings, title claims, zoning variances, building permits and violations. His corporate litigation involves construction, trade and custom practices, implied warranties, fiduciary duties and partnership responsibilities and regulatory compliance. In the past, he has also acted as bank attorney responsible for residential loan transactions and has represented the Federal Savings and Loan Insurance Corporation. He has litigated both secured and unsecured commercial loans, guarantees and commercial foreclosures.


In his banking practice he has dealt with a wide variety of defense claims involving lender liability, foreclosure rescue fraud, deceptive practices, wrongful foreclosure, loan servicing errors, defalcations, compliance, Truth in Lending Act ("TILA"), Real Estate Settlement Procedures Act ("RESPA"), Home Ownership and Equity Protection Act ("HOEPA"), repurchase and origination issues, legal standing, Mortgage Electronic Registration System ("MERS") servicing and standing issues, employee negligence and misconduct. In addition, Mr. Zaino has extensive experience in collection, workout, injunctions, asset recovery, attachments, enforcement proceedings, homestead provisions, debtor-creditor rights, replevin, commercial and residential foreclosure, REO issues, UCC Article 9 foreclosure, title issues, bank claims in bankruptcy, security agreements, competing creditor claims, and fraudulent conveyance transactions under New York Debtor and Creditor Law.
